Labour Market Impact Assessments (LMIA)

LMIAs are for corporate Canadian clients who wish to hire a foreign worker. When a Canadian company wants to hire a foreign worker, they require two things: (1) A positive LMIA decision from Employment and Social Development Canada (ESDC); and (2) the foreign worker must use the positive LMIA to secure a work permit before working at the company.

The LMIA process is used by ESDC to verify if a Canadian company has made sufficient efforts to hire a Canadian for a role before hiring a foreign worker. This program aims to protect the Canadian labour market by ensuring that employers make reasonable efforts to provide jobs for Canadians. Therefore, LMIA applications must prove that no Canadian candidates were available to fulfill the role being requested. LMIA applications are highly complex, require extensive advocacy, and proof to verify that the foreign worker is the only candidate qualified for the role.
